Supreme Court Permits Some Trump-Backed Mail-in Voting Restrictions Ahead of Midterms
In a significant development leading up to the midterm elections, the Supreme Court has partially sided with President Donald Trump's administration regarding mail-in ballot distribution. The court has put on hold a lower court's ruling that had previously blocked key aspects of the administration's plan for imposing new restrictions.
The justices, with three dissenting votes, have paused a decision by U.S. District Judge Indira Talwani. This paused ruling had prevented the Trump administration from enacting portions of a March executive order concerning the U.S. Postal Service and voter eligibility lists. The court's three liberal justices dissented from this decision.
However, this Supreme Court ruling does not immediately enable the Postal Service to implement its new mail-ballot system. A separate nationwide injunction, issued by U.S. District Judge Indira Talwani on August 11, continues to prohibit the USPS from putting the new procedures into effect for the upcoming November elections. The administration will still need to address and overcome this existing order.
The Supreme Court's majority opinion highlighted a key distinction: President Trump's executive order does not directly mandate states to alter their election procedures. Instead, it directs federal agencies to develop policies that could potentially impose requirements on states in the future. As these policies had not yet been implemented when 23 states and Washington, D.C., challenged the order, the court deemed the challenge premature.
